These Terms of Service (“Terms”) govern your access to and use of the websites, products, and services (collectively, the “Services”) provided by TraceArc AI, Inc. (“tracearc,” “we,” “us”). By accessing or using our Services, you agree to be bound by these Terms.
Eligibility
You must be at least 13 years old to use the Services. By using the Services, you represent and warrant that you meet this requirement and that you have the authority to enter into these Terms.
Your account
You must provide accurate account information and promptly update this information if it changes. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.
User content and data
You retain ownership of the content you submit to the Services. You grant tracearc a nonexclusive, royalty-free, worldwide license to use, host, store, reproduce, and process such content for the purpose of operating and providing the Services. With respect to data you label or otherwise generate through the Services (“User Data”), you grant tracearc a perpetual license to use such User Data for tracearc’s internal business purposes.
Prohibited conduct
You agree not to:
- Reverse engineer or attempt to derive the source code of the Services;
- Scrape, harvest, or collect data from the Services through automated means;
- Impersonate any person or entity;
- Access another user’s account without authorization;
- Develop or use any applications that interact with our Services without our prior written consent.
Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of liability
To the maximum extent permitted by law, tracearc’s total liability for any claim arising out of or relating to these Terms or the Services will not exceed the greater of $100 or the amount you paid to tracearc in the twelve months preceding the claim. This limitation does not apply to liability arising from gross negligence or fraud.
Dispute resolution and arbitration
Any dispute arising out of or relating to these Terms or the Services will be resolved by binding arbitration in Santa Clara County, California, and these Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. You and tracearc agree that any disputes shall be conducted only on an individual basis and not in a class, consolidated, or representative action. You may opt out of arbitration within 30 days of first accepting these Terms by emailing support@tracearc.ai with your full name and a clear statement of your intent to opt out.
Changes to these Terms
We may revise these Terms from time to time. Changes are effective upon posting. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
